1. Scope and acceptance

These Website Terms apply to the public website operated by The Play District LLC and its interest and newsletter forms. By using the website, you agree to use it in accordance with these terms. By submitting a form, you also affirmatively accept the version of these terms presented with that form.

The website provides information and signup forms for an upcoming indoor play space in Kimberly, Wisconsin. Features available before opening may differ from services offered after the venue opens.

These terms do not serve as a play-space liability waiver, admission agreement, membership contract, event or party agreement, payment authorization, media release, or release of a child’s rights. Those activities will use separate terms presented before the relevant purchase, booking, enrollment, or visit.

2. Eligibility and accurate information

You must be at least 18 years old to submit an interest or newsletter form. Submit your own accurate contact details and only information that you are authorized to provide. Children may view the informational site with adult supervision but may not submit the forms.

Do not enter children’s names, exact birth dates, health information, payment information, passwords, government identifiers, or other sensitive information in the interest or newsletter forms.

3. Form agreement and use of information

The required form checkbox confirms that you are at least 18, agree to these Website Terms, and acknowledge the Privacy Policy and the described use of the information you submit. The system records the policy and notice versions associated with a live submission so The Play District can maintain an accurate record of what was presented and accepted.

An interest submission permits The Play District to receive, store, review, and respond to the request and to use optional family details for launch and service planning as described in the Privacy Policy. It does not by itself authorize newsletter marketing, marketing text messages, or automated calls.

Newsletter permission is requested separately. Submitting the newsletter form or selecting the optional newsletter box begins a double opt-in process. Marketing enrollment is not complete until the recipient confirms through the email sent to the submitted address. You may unsubscribe later.

4. What a submission does and does not do

A confirmed interest or newsletter submission means the CRM accepted the information. It does not reserve admission, guarantee capacity, purchase a membership, enroll a child, secure a party date, create priority access, or guarantee that a requested activity will be offered.

No payment is collected through the current forms. Opening dates, hours, activities, prices, packages, capacity, and other plans may change. Concept photographs, renderings, illustrations, and descriptions communicate the intended direction and do not guarantee the final space, equipment, schedule, or service.

5. Communications

If you submit an interest request, The Play District may reply to the email address or phone number you provide about that request. Providing a phone number does not authorize marketing texts or automated calls.

Marketing emails are governed by the choice presented with the form and the Privacy Policy. You may unsubscribe using the method included in a marketing email. Service or transactional communications related to a request, purchase, booking, security issue, or active relationship may still be sent when appropriate.

6. Appropriate use

You may use the website for lawful, personal, and informational purposes. Do not submit another person’s contact information without authorization; impersonate another person; send spam or malicious content; probe or bypass security; interfere with the website; scrape the service in a disruptive manner; introduce malware; or attempt to access accounts, systems, or information without permission.

We may reject a submission, limit access, or take other reasonable steps when necessary to protect users, staff, systems, or legal rights. Automated or repeated submissions that interfere with normal operation may be blocked.

7. Intellectual property

The website’s branding, logos, text, graphics, photographs, illustrations, layout, and software are owned by The Play District LLC or used with permission and are protected by applicable intellectual-property laws. You may view and use the website for personal information about The Play District.

These terms do not transfer ownership or grant permission to reproduce, modify, publish, sell, license, or commercially use website materials without written permission from the applicable rights holder. Ordinary sharing of a public page link is permitted.

8. Third-party services and links

The website relies on service providers for hosting, database operation, security, and email delivery. It may also link to websites or services operated by others. Those services may have their own terms and privacy practices, and The Play District does not control third-party websites merely because it provides a link.

Review the applicable terms and privacy notice before giving information to a third-party service. A link does not necessarily mean The Play District endorses every statement, product, or practice of that service.

9. Availability and corrections

The website may be unavailable because of maintenance, outages, security work, or circumstances outside our control. We do not promise uninterrupted access or a particular response time. If the CRM does not confirm storage, the website will not display a successful live-submission result.

We may correct errors, update content, change features, or withdraw website material. If you believe a submission contains an error, contact Support@PlayDistrictWI.com rather than repeatedly submitting conflicting information.

10. Disclaimers and limits

The website and its content are provided for general information and launch planning. To the extent permitted by law, the website is provided without warranties that it will always be available, error-free, secure, or suitable for a particular purpose. Do not rely on website content as a confirmed booking, price, opening date, safety instruction, or professional advice.

To the extent permitted by law, The Play District LLC is not responsible for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use this informational website. Nothing in these terms limits liability or consumer rights that cannot lawfully be limited or excluded.

11. Governing law and enforceability

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any court proceeding concerning these website terms will be brought in a court with jurisdiction over Kimberly, Wisconsin, unless applicable law gives you the right to bring it elsewhere.

If a provision of these terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

12. Changes, contact, and future agreements

We may revise these terms as the website and services develop. The version and preparation date appear near the top of this page. A live form records the terms version presented with that submission. Materially different uses of information are handled under the Privacy Policy.

Future admission, booking, event, membership, payment, waiver, and family-account services may require additional agreements. If an additional agreement conflicts with these general website terms for a specific transaction or activity, the more specific agreement controls that transaction or activity.
